3. Quotes, fees and payment
Where we provide a quote, it will set out the services covered, applicable fees and any assumptions. Fees are payable in accordance with the payment terms stated in your quote or engagement letter. Unless otherwise agreed in writing:
- Invoices are payable within fourteen (14) days of the invoice date.
- Disputed amounts must be raised with us in writing within seven (7) days of the invoice date.
- Work may be suspended where an invoice remains overdue after a written reminder has been issued.
4. Your responsibilities
You agree to provide accurate, complete and current information reasonably required for us to perform the services, to provide documents and decisions in a timely manner, and to use our outputs only for the purposes for which they were prepared. You are responsible for obtaining your own independent legal, taxation and financial advice before acting on any information we provide.
5. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement. Our services come with guarantees under the Australian Consumer Law that cannot be excluded, including that services will be provided with due care and skill and will be reasonably fit for purpose.
6. Limitation of liability
To the fullest extent permitted by law, and except in relation to consumer guarantees under the Australian Consumer Law:
- We are not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue or opportunity.
- Our total aggregate liability arising out of or in connection with an engagement is limited, at our option, to resupplying the relevant services or paying the cost of resupplying them.
